General Terms and Conditions (GTC)

Scope of Application
These General Terms and Conditions (GTC) apply to all products, services, and offers provided by Pure Production AG (hereinafter referred to as “Pure Production”). They govern the contractual relationship between Pure Production and its customers. Any deviations require
written consent from Pure Production. Conflicting terms from the customer shall only apply if expressly acknowledged in writing by Pure Production.

Offer and Conclusion of Contract
The presentation of products and services in catalogs, on the website, or in other promotional materials does not constitute a binding offer but an invitation to place an order.

A purchase contract is only concluded upon written confirmation by Pure Production or upon delivery of the goods.

Pure Production reserves the right to reject orders without providing reasons.

Prices and Payment
• Prices: All prices are stated in Swiss Francs (CHF), excluding VAT and shipping costs unless otherwise specified.
• Retention of Title: Delivered goods remain the property of Pure Production until full payment has been received.
• Payment Terms: Payments must be made within 30 days of the invoice date unless otherwise agreed in writing.
• Default of Payment: In the event of late payment, default interest of 5% p.a. will be charged. Pure Production reserves the right to levy reminder fees and engage debt collection services.
• Reference to GTC: The GTC are accessible to all customers and referenced in offers, order confirmations, and invoices.

Payment Processing and Security
• Payments by credit card and other electronic payment methods are processed via the external payment service provider Worldline.
• Worldline is certified in accordance with the Payment Card Industry Data Security Standard (PCI DSS). PCI DSS is the globally recognized security standard for the processing, transmission, and storage of cardholder data.
• We do not store or process any credit card data on our own systems at any time. All payment data is transmitted directly and exclusively through the PCI DSS–compliant systems and interfaces provided by Worldline.

Delivery and Shipping
• Delivery Conditions: Delivery is made to the address specified by the customer. Delivery times may vary and are non-binding. Delivery Area: Pure Production delivers exclusively within Switzerland. Deliveries outside of Switzerland are not offered and cannot be arranged.
• Transfer of Risk: Risk of loss or damage transfers to the customer once the goods are handed over to the carrier.
• Unavailability: If a product is unavailable, the customer will be informed immediately, and any payments already made will be refunded.
• Delay in Delivery: If Pure Production is in delay of delivery, the customer may set a reasonable grace period. After expiry, the customer may withdraw from the contract if the goods have not been delivered. Further claims for damages are excluded.

Returns and Right of Withdrawal
• Customers have a right of return within 10 days of receipt, provided the goods are unused and in their original packaging.
• Excluded from this right are perishable goods, opened products, and customized items.
• Returns are at the customer’s risk and expense. After inspection, the purchase price will be refunded or replaced accordingly.

Warranty and Liability
• Warranty: Pure Production guarantees that products meet general quality requirements and are free from material and manufacturing defects.
• Exclusion of Liability: Damages resulting from improper use are excluded from liability.
• Force Majeure: Pure Production is not liable for delays or non-delivery caused by force majeure, natural disasters, pandemics, or official measures. Customers will be informed immediately in such cases.
• Compensation: Customer claims for damages are limited to foreseeable damages and excluded unless caused by intent or gross negligence on the part of Pure Production.

Dispute Resolution
• Negotiation: Disputes shall first be resolved through negotiation between the parties.
• Jurisdiction: If no agreement is reached, the place of jurisdiction shall be Laufenburg, Switzerland. Swiss law applies exclusively.
• International Customers: For international customers, Swiss law applies irrespective of the country of origin. The UN Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.

Compliance and ISO 9001-related Provisions
• Risk Management: These GTC actively cover aspects such as returns, payments, and liability in accordance with ISO 9001 requirements.
• Customer Satisfaction: The GTC promote transparency and clarity to ensure customer satisfaction and prevent legal disputes.
• Regulatory Requirements: The content complies with legal and regulatory requirements to ensure conformity.
• Industry Compliance: Pure Production ensures that all products meet applicable Swiss laws and industry regulations (e.g., Food Law, Tobacco Law, Cannabis Cultivation Regulations).

Data Protection
• The processing of personal data is carried out in accordance with Pure Production’s Privacy Policy. Data is treated confidentially and used only for contractual purposes.
• Data will only be shared with third parties when necessary for contract fulfillment (e.g., logistics partners) or when legally required.

Changes to the GTC
• Pure Production reserves the right to modify these GTC at any time. Changes will be published on the website and take effect upon publication.
• Customers who continue to place orders after publication of the updated GTC accept the new terms.

Final Provisions
• Should any provision of these GTC be invalid, the remaining provisions remain unaffected.
• In place of the invalid provision, a rule shall apply that most closely reflects the economic purpose of the invalid clause.
